The Zoning Board of Appeals (hereinafter "ZBA") reviews all applications for area or use variances.
Per NYS Law, the ZBA is directly given appellate jurisdiction. Appellate jurisdiction is the power to hear and decide appeals from decisions made by the Code Enforcement Officer (CEO) who is charged with the administration and enforcement of the Land Development Code. This is the primary function and purpose of the ZBA in zoning administration, and encompasses the power (if an appeal is properly taken to the board) to interpret the Land Development Code and to grant variances.
